Foley & Lardner LLP partner Diane Hazel appeared on the NPR podcast “Airtalk” to discuss the U.S. Federal Trade Commission (FTC) and state attorney generals’ recently filed lawsuit against Amazon.com, Inc.
“The Federal Trade Commission and the states have alleged essentially that Amazon is unlawfully maintaining its monopoly,” Hazel said. She explained the unlawful monopoly maintenance is alleged in two markets, Amazon’s online superstore market and its online marketplace services market, and that the FTC has brought two different types of claims, the monopoly claim under the Sherman Act and a standalone Section 5 claim under the FTC Act.
“We’ve seen the FTC taking a more aggressive position in other investigations and cases, but this will certainly be one of the most significant cases it brings, particularly under this Administration,” Hazel added.
