Donald Schroeder on Massachusetts Gig Driver Ballot Initiative – 'This is just the first round'
Foley & Lardner LLP partner Donald Schroeder commented in the Law360 article, “Mass. Initiative Could Set Up Novel Gig Driver Union Scheme,” offering perspective on a ballot initiative in Massachusetts that would extend a form of union rights to ride-hailing drivers.
Schroeder said he takes issue with the measure, explaining that it puts what should be a legislative decision in the hands of voters. He also noted the ballot measure has aspects that its proponents may not have completely thought through, including the complexities involved with settling on platform-wide standards for drivers whose hours and practices can widely vary, and expected legal challenges owing to the measure’s resemblance to other labor laws.
“This is just the first round,” Schroeder added. “I see a flurry of activity after this, if it does pass.”
