Brian Tomkins is a seasoned intellectual property attorney with a practice spanning the full spectrum of IP law. His wide experience encompasses patent preparation and prosecution, global IP asset strategy, including litigation strategy and management, and high-level transactional work across M&A, licensing, development and technology agreements, and joint ventures.
Brian’s extensive practice covers a diverse range of sectors, with particular emphasis on the medical devices, pharmaceuticals, biotechnology, software, blockchain, agriculture technology, and financial services industries. With a deep background at the intersection of IP and a company’s bottom line, Brian offers clients informed patent counseling to develop practical strategies that further a client’s business goals. He regularly advises on the acquisition or development of new technologies and product lines to ensure maximum protection while simultaneously gauging risk relative to third party IP. Brian additionally assists clients in formulating strategies to manage risk, including clearance opinions, challenges to third party intellectual property, and license and settlement agreements, and is well-versed in litigating various patent, trademark, copyright and trade secret issues, including pharmaceutical and biotechnology patent litigation.
Prior to joining Foley, Brian was a partner at a boutique IP firm in New Jersey, where he worked closely with clients to develop and execute global IP strategies that support their business goals and provided critical counsel during complex corporate transactions.
