Christopher Swift Quoted on Legal Challenge to Block of Nippon's U.S. Steel Acquisition

Foley & Lardner LLP partner Christopher Swift commented on a lawsuit filed by Nippon Steel and U.S. Steel challenging the Biden administration’s decision to block Nippon’s acquisition of U.S. Steel in The Capitol Forum article, “Legal Challenge to Biden Ban Faces Tough Odds.”
Courts are historically reluctant to overturn presidential decisions grounded in national security concerns, with the most recent challenge coming in 2014 when the Ralls Corporation unsuccessfully challenged an order by President Obama.
“It will be interesting to see if the parties can articulate an alternative argument that isn’t addressed under the Ralls precedent,” Swift said.
