Neuberger commented on remote work, saying that employers should assess the jurisdictional questions raised by a remote workforce to ensure compliance.
“If I have one employee in Utah, Do I have to comply with all the employee laws in Utah for that one employee?” Neuberger said. “Maybe yes, maybe no. Got to look.”
He also discussed the intersection of wage and hour issues with employee status, particularly during natural disasters.
Neuberger said overtime-exempt employees who miss a day of work during a work week shouldn’t be docked pay but noted that “it’s an issue” for non-exempt workers.
“If you believe in paid leave laws,” he added, “should there be paid leave for hurricane shutdown or flood shutdown or wildfire shutdown?”
