Klinsport and Atallah Help Secure Landmark Settlement in Pro Bono Case on Behalf of Students with Diabetes

Los Angeles attorneys Kimberly Klinsport and John Atallah helped negotiate a landmark settlement that will make the Upland, Calif., Unified School District safer and more accessible for students with diabetes.
The Foley attorneys, working pro bono on the case with the Disability Rights Legal Center, sued the school district in 2016 for allegedly failing to appropriately accommodate the needs of an 11-year-old girl with type 1 diabetes in violation of federal and state disability laws.
Under the settlement, approved last week by U.S. District Judge R. Gary Klausner, the school district will change how it treats students with diabetes, including creating a handbook designed to train and inform employees on the best practices and methods for providing care for students with diabetes and designating at least three on-site staffers specially trained in diabetes care and management at each school attended by a student with diabetes.
In addition to improving the educational experience of students in the district with diabetes, the settlement may save lives, Atallah said. “Because of this settlement, students with diabetes have a chance to be successful in school without having to worry about whether their medical needs will be appropriately addressed,” he said.
