Law360 recently spoke with partner Rachel Powitzky Steely, co-chair of the Firm’s labor and employment practice, about the Texas Supreme Court’s decision to hear a case that challenges Houston’s same-sex employee benefits program.
Ms. Steely told the publication that she believes the political push to have this matter reviewed is part of a plan to have Obergefell vs. Hodges, the 2015 decision that legalized same-sex marriage, reargued before the U.S. Supreme Court. “It’s an attempt at a second bite at the apple,” she said.
She also stated that because the Texas justices have only granted a review of the case, she recommends that employers “wait to see how things shake out” before reacting to the potential law changes.
