Law360 covered U.S. District Court Judge Lynn Hughes' refusal to grant the Securities and Exchange Commission's request to bar Anthony Nocella and Russell McCann, former officers of the failed bank Franklin Banking Corp., from serving as a director or officer of a public company. Judge Hughes found that, while Franklin Banking Corp. improperly accounted for mortgage modifications it made in 2007, there was nothing flagrant about the behavior of Mr. Nocella, former chief executive officer, or Mr. McCann, former chief financial officer, that would justify banning them.
