Oxford University Press and Foley are pleased to announce the publication of “Intellectual Property Law of Plants,” the first book to provide practical analysis on the creation and implementation of specialized, plant-specific intellectual property.
Co-written by an expert team of academics and practitioners, including Foley Partner Richard Peet as well as Herbert Jervis and Mark Janis, this book examines plant and plant biotechnology innovation and law from a global perspective. Specifically, it compares plant intellectual property law in the United States and other jurisdictions.
Addressing the complexities and unique nature of plant intellectual property (IP) law, featured topics include:
- IP law framework for plant innovation
- Innovation in plant breeding
- Overview of International Union for the Protection of New Varieties of Plants systems
- U.S. plant variety protection
- Plant breeders’ rights outside of the U.S.
“Plant intellectual property law is a niche which stands apart from other IP endeavors because of its complex nature,” said Richard Peet, book coauthor and former chair of Foley’s Chemical and Pharmaceutical Practices. “This book seeks to explain the key issues involved and simplify those complexities.”
Additionally, full treatment is given to the legal and technological framework; important intellectual property regimes in plant breeding; formal grants of rights under plant variety protection schemes; plant and utility patent regimes and trademark regimes. Antitrust restrictions on intellectual property licensing and international regulations on plant genetic resources are also covered in detail.
