Through her leadership roles as the Los Angeles Office Managing Partner, Litigation Chair for the Los Angeles and San Diego offices, and Co-Chair of the Cybersecurity and Privacy area of focus within Foley & Lardner LLP’s nationwide Innovative Technology sector, Kimberly Klinsport is passionate about staying ahead of the curve on emerging legal trends. Whether representing Fortune 100 companies in commercial disputes through trial or arbitration, advising on cybersecurity and data privacy concerns, or providing counsel on insurance coverage issues, Kimberly is equally comfortable proving client cases before juries and settling matters amicably out of court.
Kimberly’s commercial expertise includes the successful resolution of disputes relating to contract termination and performance across a wide variety of industries including food and beverage, manufacturing, and healthcare. Her practice in these areas is particularly focused on fraud, payment disputes, and the scope of fiduciary duties, while also regularly providing counsel to companies litigating copyright, trademark, and licensing disputes.
And if negotiations break down, Kimberly is unafraid to stand up for her clients. Whether through arbitration or before judge and jury, she leverages her experience arguing before courts across the country to make key points and create favorable outcomes.
Industry-specific focal points include the intersection of health care & life sciences and insurance, where Kimberly has experience litigating a wide range of cutting edge areas of contention: provider-payor payment claims, coverage actions, ERISA litigation, and other issues related to the reasonable and customary value of service charges. She frequently provides counsel on recoupment and medical necessity claims, including the representation of counties in administrative hearings before the California Department of Health Care Services.
Finally, Kimberly represents clients within the insurance industry on complex insurance brokerage and agency litigation. In addition to her experience leading bad faith litigation matters, she has particular experience in coverage issues involving cybersecurity and data privacy, director and officer liability, construction projects, additional insureds, and policies with multiple insurers on the risk.
While in law school, Kimberly served as the note and comment editor of the Loyola of Los Angeles Law Review and was a judicial intern for the Honorable Gary A. Feess, U.S. District Court Judge.
Kimberly Klinsport was recently named to the Top 100 Lawyers by the Los Angeles Business Journal for 2024 and has long been recognized for her achievements as a trial lawyer. From her first experience second-chairing a two-week jury trial that resulted in a unanimous defense verdict as a junior associate to her most recent victories as lead trial counsel representing clients on both sides of the “v”, Kimberly focuses on obtaining her clients’ strategic business objectives through trial and arbitration. Prior to the pandemic, she settled a jury trial after the cross-examination of the other side’s two main witnesses, and during the pandemic, she achieved an arbitration award in her client’s favor resulting in the recovery of over a million dollars in fees after a week-long, in-person hearing. In recent years, Kimberly has represented innovative technology start-ups to some of America’s most well-known brands. Even more recently, she favorably resolved a matter on the eve of trial for one of the country’s most recognizable sports brands.
In all of her matters, Kimberly leads diverse trial teams who are adept at distilling complex concepts and crafting compelling stories that are easy for juries to follow. She has successfully used pretrial motion practice to decimate an opponent’s narrative of their case to set her clients up for favorable pretrial resolution. Above all else, she is focused on how to manage matters in her clients’ best interest.

Community Involvement
Kimberly is an active member of her community and committed to providing pro bono legal services. She currently serves on the Board of Directors for the Legal Aid Foundation of Los Angeles (LAFLA) and previously served as an executive board member of the Associates Advisory Board for LAFLA from 2010 – 2018, including the honor of serving as chair of the board from 2016 – 2018. In addition to providing pro bono legal services through LAFLA and the Inner City Law Center, Kimberly has provided pro bono legal services to veterans and adoptive parents in adoption proceedings. She has also handled multiple sensitive guardianship proceedings for a client with special needs and a transgender youth.
