Partner Nathaniel Lacktman, chair of Foley’s Telemedicine & Digital Health Industry Team and member of the Board of Directors of the ATA, and senior counsel Aaron Maguregui, co-chair of the firm’s Data Analytics/Intelligence Area of Focus, will speak at the upcoming 9th Annual Northeast Telehealth Resource Center (NETRC) Conference on September 18, 2023 in Nashua, NH.
Mr. Lacktman’s session is titled “Telemedicine Law & Regulation in the Northeast and Beyond.” The presentation will explore the state of telemedicine law for the seven regional NETRC States, starting in 2019 and comparing it to the current state in 2023, post-COVID. Attendees will assess the telemedicine laws of the seven NETRC states, and illustrate the differences/progress compared to pre-2020 laws. They will highlight today’s key legal issues in building and growing a telemedicine service, including ecommerce, privacy, prescribing, and subscription membership models. It will conclude with a look ahead on what we might expect from telemedicine and digital health in 2024.
Mr. Maguregui’s session is titled “Online Tracking Technologies: Implications under HIPAA and Beyond.” In light of heightened scrutiny related to use of online tracking technologies (e.g., cookies and pixels) in the health care space, including recent HHS guidance and FTC enforcement action, this presentation will guide digital health organizations on assessing their use of online tracking technologies. This presentation will address key questions including (i) how the data derived from analytic and tracking technologies via a website or mobile application is regulated; and (ii) the legal requirements an organization needs to consider before using tracking technologies to process data which may be considered HIPAA protected health information or otherwise personally identifiable.

It provides free, individualized technical assistance, education, and other resources in collaboration with the Consortium of Telehealth Resource Centers, MCD Global Health, and the University of Vermont.
