The rapid growth of mHealth technologies and arrangements offers enormous benefits to the health care community, along with the potential for improved patient care, outcomes, satisfaction and efficiency. It similarly offers great promise for new business models and arrangements. However, when designing a mHealth business platform, business leaders must be aware of the signficiant differences in state law regulating telemedicine practice. The current legal landscape is not uniform and some states have only recently started updating their regulations to become current with advances in technology and the practice of telemedicine. In addition, many mHealth businesses need to structure their arrangements to comply with the Anti-Kickback Statute and physician self-referral laws. These issues become more complicated depending if the mHealth business model is provider-to-provider, or direct-to-patient, or a variant of the two.
The session will highlight these legal issues associated with telemedicine and mHealth, but with a particular emphasis on practical discussion and real world application of these rules. The rules will be explained and applied through a series of six real world mHealth and telemedicine case studies. Participants will also have an opportunity to propose their own case study questions to be discussed during the session. At the conclusion of this session, participants will have a better understanding of the key legal and compliance issues in telemedicine and mHealth arrangements. In addition, they will learn how to apply these rules to their own business models and contractual arrangements.
