CMS recently introduced an important change to the so-called “3-Day DRG Payment Window” that will prohibit hospital owned/operated physician practices from billing for certain non- diagnostic services when a patient is subsequently admitted to the hospital — even if the practice is not provider-based. This new rule is causing health systems to re-evaluate their decisions on provider-based and to rapidly institute compliance safeguards and protocols to avoid improper billing, overpayments, and other legal risks.
