The federal False Claims Act (FCA) has become the government’s primary weapon to fight fraud in government health care programs. In recent years, the reach of the FCA has expanded, exposing providers to potential liability at virtually every stage of the provider-government relationship.
Violations of the FCA could result in significant fines, ineligibility for government health care programs and possible criminal prosecution. In 2006, the Department of Justice collected $2.2 billion in settlements from health care companies for FCA violations.
Providers participating in government programs must understand the expanding theories of liability under the FCA and develop policies to ensure compliance.
