On Thursday, September 19, 2013, please join Foley’s Environmental attorneys for a presentation on recent key leadership appointments at EPA, as well as an update on important new CAA developments and the status of significant pending CAA rules, including:
- Several recent judicial decisions curtailing EPA’s new source review (NSR) enforcement authority and pitfalls that may remain for sources despite these rulings
- The status of the “Cross-State” rule as it awaits U.S. Supreme Court review, and EPA’s recent policy pronouncements regarding pollutant transport in the interim
- The status of EPA (and D.C. Circuit) consideration of numerous petitions regarding the new “boiler MACT” and “CISWI” rules issued in 2013
- The status of EPA’s plans to regulate greenhouse gas (GHG) emissions from new and existing power plants and our thoughts on what those rules might look like
- A brief run-through of several significant D.C. Circuit opinions on CAA rule challenges
