Foley attorneys Jennifer Hennessy, Aaron Maguregui, Caitlin Otis, and Jaide Lee Beverly will be hosting a session at the 2023 California Telehealth Summit titled “Telehealth Law & Policy Panel.”
This panel will discuss the rapid expansion of telehealth practices during the COVID-19 pandemic, and how states and the federal government alike have passed sweeping legislation and guidance intended to regulate and oversee telehealth providers and organizations. In light of these new legal requirements and heightened regulatory scrutiny, this presentation will address key regulatory issues facing digital health organizations today and in the near future. Specifically, this presentation will address (i) current enforcement trends, with a particular focus on the use of online tracking technologies by digital health organizations in light of recent HHS guidance and FTC enforcement action related to the use of these technologies; (ii) state licensure requirements and exceptions; and (iii) state telehealth practitioner practice standards.
