State of Confusion: How to Make Sense of Continually Emerging State Privacy Laws
Foley’s Steve Millendorf (Partner, San Diego) and Samuel Goldstick (Senior Counsel, Chicago) will join the ABA Science & Technology Law Section’s panel on “State of Confusion: How to Make Sense of Continually Emerging State Privacy Laws” at the upcoming 2025 Privacy and Emerging Technology National Institute.
With 20 US states having enacted comprehensive privacy laws (with other states considering such legislation), and so many other new state laws focusing on the privacy of particular types of personal information (health, biometric, children), it’s hard to make sense of it all.
This panel will address the commonalities and variations in these state laws, including exemptions for personal data protected under federal privacy laws, and offer guidance on establishing and maintaining practical policies and practices to comply with myriad applicable laws cohesively. The panelists will:
- Provide insights on how to satisfy core legal obligations, including the required content and form of privacy notices, ways to offer and honor consumers’ choices regarding specific uses and disclosures of their personal data (including opt-out and opt-in mechanisms), what is involved in data privacy assessments, and global privacy controls
- Discuss deadlines, prerequisites, and options for acknowledging and responding to consumer requests, such as access and deletion
- Explain how the laws govern the use of personal data for AI or individual profiling
- Highlight recent enforcement actions and lessons learned
