Baum discusses a federal appeals court ruling that prevents e-commerce businesses such as eBay from being held liable for trademark infringement when counterfeit goods are sold in its online shops. He states that online retailers should not interpret the ruling as a free pass in similar cases, noting the substantive steps eBay takes to police against counterfeits as examples of what the court expects for good-faith efforts to prevent infringement.
