Carrie B. Hoffman spoke to Androvett Legal Media & Marketing about the Fair Labor Standards Act and how it plays into staffing for the holiday season. Ms. Hoffman is a partner in Gardere's Labor and Employment Practice Group.
"No matter how busy you might get and how innocent the request may be, managers need to remember that asking workers to work, even briefly, off the clock – whether it be through a meal or during a scheduled break – is never an option," Ms. Hoffman said. "Expecting work off the clock is a guarantee you will not only end up wearing out your workforce and creating resentment, but also end up facing a Department of Labor audit or a private collective action."
