Law 360 covered the ongoing legal battle between Gardere client Cardtronics Inc. and Lloyd's of London. The battle stems from the suit filed by Cardtronics against Lloyd's related to a $16 million cash theft. Lloyd's asserted Cardtronics was required to first pursue the armored car company who was responsible for the loss, arguing that Cardtronics' insurance coverage wasn't properly triggered until Cardtronics "exhausted all of its remedies" against the armored car company and its insurers.
Writing for a unanimous panel, 1st District Court of Appeals Justice Harvey G. Brown affirmed a lower court's decision, finding that Cardtronics' claim is immediately payable, and remanded the case back to trial court. Gardere Partner Stephen L. Moll, an attorney for Cardtronics, said it was pleased with the opinion, calling it "well-reasoned, clear and, in my view, unassailable."
