Foley attorneys Jonathan Moskin, Brian Kapatkin, Katherine Califa and Eoin Connolly successfully represented one of the largest online travel sites, Booking.com, in helping it to reverse the Trademark Trial and Appeal Board’s (TTAB) previous finding that its mark was generic.
A federal judge in the United States District Court for the Eastern District of Virginia reversed a decision by TTAB, finding that the clients mark was not generic. One of the applications was for the word mark and three were for stylized versions of the mark.
The federal judge found that the client’s word mark was descriptive and that the client had met its burden of demonstrating the mark’s secondary meaning as to its service services. The United States Patent and Trademark Office has been ordered to register the client’s trademark.
