Donald Schroeder Comments on Newly Elected National Labor Relations Board Members

Foley Labor & Employment Partner Donald Schroeder was quoted in a Law360 article, “4 Issues In Play As New Biden NLRB Members Settle In,” about anticipated changes the National Labor Relations Board will bring about now that the Democrats hold the majority.

Schroeder said, “They now have the majority, they’ve got the chairperson, they’ve got the 3-2 split. I would expect a fairly robust effort by the board that’s currently constituted to put its thumbprint on the law.”

Schroeder also commented that the U.S. Supreme Court’s recent ruling in NCAA v. Alston “may temper student-athletes’ incentive to unionize by freeing them up to ink endorsement deals and profit off their likenesses. Still, it’s a matter of when, not if another group of student-athletes seeks a union election in light of Abruzzo’s memo.”
