Daniel Kaplan Quoted on Supreme Court Decision to Block Vaccine Mandate for Large Businesses
Partner Daniel (Dan) Kaplan was quoted in a Yahoo! Finance article titled “Supreme Court blocks vaccine mandate for large businesses, allows it for health care workers” that discusses a January 13 decision by the Supreme Court to temporarily block the a Biden Administration’s Covid-19 vaccine mandate for large employers, but allowed a separate rule to move forward that applies only to health care workers at facilities that receive federal funding.
“For all intents and purposes, the ETS is now ‘dead’ until the 6th Circuit Court of Appeals rules on the merits of the rule, or OSHA promulgates a rule consistent with the notice and comment requirements,” Kaplan said. He anticipates that employers that had not contemplated mandatory vaccination programs for fear of losing labor, are now much less likely to implement any form of vaccination mandate or requirement.
