Foley & Lardner LLP Partner Meng H. (Paul) Pua was featured in the article, “VR, 5G, and wireless comms: how counsel can conquer top tech,” in Managing IP discussing trends in the most patented technologies such as wireless communications and how private practice prosecutors can hone their expertise in these growing technology fields.
Pua said, “companies sometimes have to use features from other wireless technologies to upgrade their innovations” but need to be prepared to overcome obvious rejections by the United States Patent and Trademark Office for 5G and wireless communications applications. He said “attorneys might get around these objections by arguing that an invention doesn’t incorporate every aspect of another technology, but rather mixes features from different technologies in a way that isn’t obvious to a person of reasonable skill” and that “counsel can also contend that such combinations aren’t obvious on the basis that they require a lot of engineering or reengineering.”
