Christopher Swift Discusses Presidential Election's Impact on CFIUS Approach
Foley & Lardner LLP partner Christopher Swift assessed the potential approaches of the U.S. presidential candidates towards the Committee on Foreign Investment in the United States (CFIUS) in The Capitol Forum article, “Trump, Harris Likely to Pursue Different CFIUS Approaches to Achieve Common Goal: Confronting China.”
“Under President Trump, CFIUS may be more likely to take a more aggressive approach and potentially unwind deals, as it tended [during his first term] to pick winners and losers rather than adhering to a more systematic bureaucratic review process,” Swift explained. “Under President Harris, CFIUS appears more likely to encourage parties to voluntarily file with the committee while enhancing its monitoring and enforcement powers to oversee national security agreements that mitigate risks posed by transactions.”
