Jason Mehta Shares Perspective on Biggest Government Contracts Cases of 2024
Foley & Lardner LLP partner Jason Mehta commented on the legal battle over the constitutionality of the False Claims Act’s qui tam provision in the Law360 article, “Top Gov’t Contracts Cases Of 2024.”
Mehta, who led the Foley team that secured a precedent-setting victory in a constitutional challenge to the FCA’s qui tam provisions in October 2024, said that it is not necessarily the case that would be no role for relators to play in future FCA cases.
He noted as an example the model used in the U.S. Department of Justice’s pilot program for whistleblowers to report corporate misconduct.
“To me, that does not run afoul of the Constitution,” he commented. “There’s still, I think, quite a roadmap and quite a role for whistleblowers and their attorneys going forward.”
