Ruben Rodrigues is a partner and intellectual property trial and appellate lawyer with Foley & Lardner LLP. He manages patent litigation matters for technology companies of all sizes on cases involving software, semiconductors, medical devices, exercise equipment, telecommunications, 3D printing, health monitoring technologies, offshore technologies, the Internet of Things “IoT,” and others. Ruben also represents clients in post-grant review proceedings before the U.S. Patent & Trademark Office and counsels clients on general IP strategy and licensing issues. He has a national practice and has represented clients in cases filed in Massachusetts, Delaware, Texas, California, Illinois, Virginia, Wisconsin, Georgia, Rhode Island, Florida, Tennessee, and Utah as well as the International Trade Commission (ITC). He is a member of the firm’s IP Litigation and Electronics Practices and the Technology Industry Team.
Prior to joining Foley, Ruben interned at the Massachusetts Governor’s Office of Legal Counsel.
Representative Experience
- Represented global manufacturer of connected fitness and exercise equipment in patent, trade dress, trade secret, and false advertising disputes in a number of complex matters in multiple venues, including the District of Delaware, Patent Trial & Appeal Board (PTAB), and the International Trade Commission (ITC).
- Represented global manufacturer of children’s products and toys in an IP licensing dispute with more than US$100M at issue, securing a jury verdict in our client’s favor at trial as well as an award of attorneys’ fees in the Northern District of Georgia as well as the U.S. Court of Appeals for the 11th Circuit.
- Represented global technology company in multiple patent infringement disputes against makers of fitness trackers and smartwatch technologies in multiple venues, including the District of Massachusetts, Central District of California, Northern District of California, PTAB, the ITC, and the U.S. Court of Appeals for the Federal Circuit.
- Represented leading U.S. research university in patent litigation disputes between licensees involving next-generation sequencing (NGS) technology and spatial transcriptomics in the District of Massachusetts, District of Delaware, as well as the PTAB.
- Represented global leader in offshore seismic data acquisition in multiple lawsuits involving claims of patent infringement and unfair competition brought against competitors relating to design and operation of seismic data acquisition units in the Southern District of Texas, the PTAB, and the U.S. Court of Appeals for the Federal Circuit.
- Represented manufacturer of electronic components in appeals of multiple PTAB decisions involving capacitor technology to the U.S. Court of Appeals for the Federal Circuit.
- Represented global electronics company in multiple patent infringement and license disputes with patent-holding entity concerning semiconductor packaging technology, resulting in settlement on eve of trial.
- Represented developer of business intelligence software in patent infringement disputes with competitor in the Northern District of Illinois and Eastern District of Texas, successfully limiting an award of damages at trial (followed shortly by global settlement).
- Represented many technology companies and startups in resolving patent infringement lawsuits brought by patent-assertion-entities (PAEs) often referred to as “Patent Trolls” in many venues, including the District of Delaware, Eastern District of Texas, Western District of Texas, and Northern District of California.
